Terms of Service
These Terms of Service (the "Terms") govern your access to and use of the Trawl platform operated by Pierre Brisorgueil, a French auto-entrepreneur (Entreprise Individuelle, profession libérale, non-VAT-charging under Article 293 B CGI), registered at 4 avenue de l'Église, 44500 La Baule-Escoublac, France, SIREN 793 833 179 ("Trawl", "we", "us"). By creating an account, accessing the dashboard, or using any part of the Service, you ("User", "you") accept these Terms in full. If you do not agree, do not use the Service. The Acceptable Use Policy in Section 5 (the "AUP") and the User Responsibility provisions in Section 6 form an inseparable part of these Terms.
1. Introduction
Trawl is a SaaS web scraping orchestration platform that lets professional users define, schedule, and operate web scrapers on Trawl-operated infrastructure. Trawl provides the orchestration layer, an AI-powered auto-fix feature, and integrations with third-party tooling (proxies, captcha solvers, AI providers). Trawl does not itself collect data on your behalf as a primary purpose; it executes scraping configurations that you define and for which you remain solely responsible. These Terms apply jointly with the Privacy Policy at /privacy, the Refund Policy at /refund, the Data Processing Agreement at /dpa, the Acceptable Use Policy at /aup (which expands and clarifies Section 5 below), and the Mentions légales at /mentions-legales. The AUP in Section 5 below is binding and any breach is a material breach of these Terms; the standalone /aup page is a clarifying expansion of Section 5 and is subordinate to it in case of conflict.
2. Definitions
In these Terms, the following terms have the meanings set out below.
- Trawl: the software-as-a-service platform operated at
trawl.me, including the dashboard, public APIs, scrap execution engine, and supporting services. - Service: the Trawl platform as a whole, including any feature, integration, or update made available by Trawl.
- User: the natural or legal person who has accepted these Terms and uses the Service in a professional capacity.
- Subscription: a paid plan (Growth, Pro) or the Free tier under which the User accesses the Service.
- Compute: the metered consumption unit used to price scraper executions, expressed in compute credits and reset on a weekly cycle.
- Managed Mode: operating mode where Trawl runs scrapers on Trawl-operated infrastructure.
- Scrap: a User-defined scraping configuration, including target URLs, navigation, selectors, output schema, and execution schedule.
- AI Auto-fix: the AI-powered feature that may suggest or apply modifications to a Scrap when target sites change.
- Sub-processor: any third party engaged by Trawl to process Personal Data on behalf of the User, as listed in the Privacy Policy and the DPA.
3. Eligibility and Account
You must be at least eighteen (18) years old and have the legal capacity to enter into a binding contract in your jurisdiction. The Service is reserved for professional use; by registering, you warrant that you act in a professional capacity. Each natural person may hold a single individual account; a legal entity may invite team members through the User management feature. Automated signup, signup using disposable mailboxes intended to abuse the Free tier or the Pro trial, and signup on behalf of a person who has not consented are prohibited. You undertake to provide accurate, complete, and up-to-date registration information, including a valid contact email and billing details where applicable. You are solely responsible for the security of your account, including the confidentiality of your password and any API tokens issued to you. You must notify Trawl without delay at brisorgueilp@gmail.com of any suspected unauthorized access. Trawl reserves the right to suspend any account that does not comply with this Section.
4. Subscriptions, Plans, and Pricing
Trawl offers a Free tier, a Growth plan at USD 39 per month, and a Pro plan at USD 159 per month. Each plan includes a weekly compute allowance that resets every seven days at the same weekday and time as the initial subscription event; unused compute does not roll over. The exact compute allocations, rate-limits, and feature availability per plan are described on the public pricing page and may evolve with thirty (30) days' notice in line with the rules set out below. In addition, paid users may purchase one-shot compute packs (Boost, Power, Bulk, Industrial) that are non-rechargeable, non-refundable once purchased, and consumed before the weekly allowance.
New users may activate a fourteen (14) day Pro trial without providing a credit card; at the end of the trial, the account automatically falls back to the Free tier and continues to operate within Free-tier limits unless the User actively subscribes to a paid plan. The Pro trial is single-use per natural person, may not be combined with any other promotion, and is reserved for genuine evaluation; abusive trial activations (multiple disposable mailboxes, automated signups) are grounds for suspension under Section 14.
Pricing is denominated in U.S. dollars and exclusive of any applicable taxes; Trawl does not currently charge VAT on invoices issued under the franchise en base de TVA regime (Article 293 B of the French General Tax Code), but you remain responsible for any tax due in your own jurisdiction. Subscriptions are billed in advance on a monthly recurring basis through Stripe; the User authorises Trawl to charge the registered payment method on each renewal date until the Subscription is cancelled. Pro-rata is not applicable to plan changes during a billing period; mid-cycle plan changes (upgrade or downgrade) take effect at the next billing period. Trawl reserves the right to update pricing with thirty (30) days' prior notice; price changes apply at the next renewal and the User may cancel before the effective date if they do not accept the new pricing.
5. Acceptable Use Policy
The following Acceptable Use Policy applies to all uses of the Service and is a material part of these Terms. Any breach is grounds for immediate suspension under Section 14.
You shall not use Trawl to: (i) collect non-public information, including data behind login or paywall; (ii) access, collect, transmit, distribute, or store material protected by copyright, trademark, trade secret, or any other intellectual property right without proper prior authorization; (iii) circumvent technical protection measures (CAPTCHA, rate limits, IP blocks) on websites that have explicitly prohibited automated access in their terms of service or via robots.txt; (iv) conduct denial-of-service attacks or any activity causing undue burden on third-party servers; (v) engage in ad fraud, click fraud, fake engagement, or SEO manipulation; (vi) harvest personal data without a valid legal basis under applicable data protection law, including GDPR; (vii) train AI/ML models on scraped data in violation of the source's terms of use or applicable copyright; (viii) operate against streaming domains (video, audio, image streaming services); (ix) target government, banking, or healthcare websites without explicit written authorization from Trawl's compliance team.
This list is non-exhaustive. Trawl may update the AUP from time to time to reflect emerging risks; updates take effect on publication on /terms and apply to all subsequent uses of the Service.
6. User Responsibility — Scraping
Prior to deploying any scraper through Trawl, the user undertakes to: (i) read and respect the terms of service and privacy policy of each targeted website; (ii) honor exclusion protocols, including but not limited to robots.txt; (iii) cease scraping any website that explicitly prohibits automated collection through technical (CAPTCHA, IP blocking) or legal means (Terms of Use). Trawl provides users with technical means to enforce these obligations (rate limiting, robots.txt parsing) but does not enforce them by default. The user retains full discretion and full responsibility.
You are solely responsible for assessing the lawfulness of each scraping operation in light of the law applicable to the source site, the law applicable to the data subjects whose Personal Data may be collected, and the contractual terms governing the source site. Where a scraping operation collects Personal Data, you act as the data Controller within the meaning of Article 4 of the GDPR and Trawl acts as a Processor within the meaning of the DPA at /dpa. You are responsible for establishing a lawful basis under Article 6 of the GDPR and for any notice and consent obligations toward the data subjects.
7. Operational Modes
Trawl currently operates in a single Managed mode: scrapers run on Trawl-operated infrastructure, with Trawl providing the orchestration layer (scheduling, proxy routing, anti-bot resolution, AI Auto-fix, output delivery). Additional execution modes (including user-controlled infrastructure) may be introduced in the future and will be governed by an updated version of these Terms and the AUP.
In Managed mode, Trawl acts as a technical service provider executing user-defined instructions; Trawl does not validate the lawfulness of the User's scraping configuration. The User is solely responsible for: (i) the legality of each scraping operation against each target website; (ii) compliance with the target's terms of service and robots.txt directives; (iii) the lawful basis for processing any personal data collected; (iv) all credentials supplied to Trawl (proxies, captcha solvers, target-site logins).
The User remains the sole decision-maker regarding the targets to scrape, the frequency of execution, the scope of data captured, and the downstream use of any output. Trawl does not pre-screen Scraps, does not interpret target site terms on the User's behalf, and does not inspect output for legality.
8. AI Auto-fix Disclaimer
Trawl includes an AI-powered auto-fix feature that may automatically modify scraper configurations (selectors, navigation flows, output schemas) when target sites change. The user acknowledges that: (i) AI-generated modifications are best-effort, may be incorrect, and may produce unexpected results; (ii) the user is solely responsible for reviewing and validating any auto-fix changes before relying on the output for business or production purposes; (iii) Trawl makes no warranty as to the accuracy, completeness, or suitability of AI-generated configurations; (iv) the user may disable AI auto-fix at any time in the project settings. Trawl does not use the user's scraper configurations or scraped data to train any third-party AI model without prior explicit consent.
Where AI Auto-fix routes a request to a third-party AI provider (Anthropic, OpenAI, DeepSeek), the request is governed by the relevant provider's data processing terms and the additional safeguards described in the Privacy Policy at /privacy Section 7 and the DPA at /dpa Annex 2.
9. Intellectual Property
Trawl and its licensors retain all right, title, and interest in and to the Service, including without limitation the platform code, the dashboard, the orchestration engine, the AI Auto-fix logic, the documentation, the trade marks, and the brand "Trawl". No provision of these Terms transfers any intellectual property right in the Service to the User other than the limited license to use the Service granted by these Terms. Subject to your compliance with these Terms, Trawl grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your internal professional purposes during the term of your Subscription.
The User retains ownership of (a) the scraper configurations they create through the Service and (b) the data output produced by their Scraps, subject to the AUP and to any third-party right that may attach to such data. The User grants Trawl a worldwide, royalty-free, non-exclusive, non-transferable license to host, process, and operate the configurations and outputs strictly for the purpose of executing the Service and providing ongoing operations (including troubleshooting and AI Auto-fix at the User's option). This license terminates automatically upon cancellation of the Subscription or deletion of the relevant configuration. Any feedback, suggestion, or enhancement request that the User voluntarily submits to Trawl is provided on a non-confidential basis and may be incorporated into the Service without compensation or attribution to the User.
10. Confidentiality
Each Party undertakes to keep confidential any information designated as confidential by the disclosing Party or that should reasonably be considered confidential by reason of its nature or the circumstances of its disclosure. Confidential information shall not be used for any purpose other than the performance of these Terms and shall not be disclosed to any third party without the prior written consent of the disclosing Party, except to employees, contractors, or advisors bound by equivalent confidentiality undertakings and on a need-to-know basis. The confidentiality obligation survives termination of these Terms for a period of five (5) years. The obligation does not apply to information that (a) was already in the public domain without breach, (b) was independently developed without use of the disclosed information, or (c) must be disclosed pursuant to a binding legal or regulatory obligation.
11. Warranty Disclaimer
The Service is provided AS IS and AS AVAILABLE, without warranty of any kind, whether express, implied, or statutory. Trawl expressly disclaims all warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, and uninterrupted operation. Trawl does not warrant that the Service will meet the User's requirements, that scraper executions will succeed against any specific target site, that AI Auto-fix will produce correct configurations, or that the Service will be free of bugs, errors, or interruptions. No uptime is guaranteed except where Trawl has expressly undertaken a service level agreement in a separate signed instrument.
12. Limitation of Liability and Time-Bar
Trawl's aggregate liability under this Agreement shall not exceed fifty percent (50%) of the fees actually paid by you to Trawl during the six (6) months preceding the event giving rise to the claim. Any claim against Trawl shall be time-barred one (1) year from the date of the harmful event. In no event shall Trawl be liable for indirect, incidental, special, consequential, or punitive damages, loss of profit, loss of data, or loss of business opportunities.
The above limitations and exclusions apply to the maximum extent permitted by applicable law. Nothing in these Terms limits or excludes liability that cannot be lawfully limited or excluded under French law, including liability for fraud, gross negligence, or wilful misconduct.
13. Indemnification
You agree to defend, indemnify, and hold harmless Trawl, its officers, employees, contractors, and affiliates from and against any third-party claim, demand, action, or proceeding, and any related loss, damage, liability, settlement, or reasonable legal cost, arising out of or in connection with: (a) your scraping activities, including but not limited to claims by source-site operators, data subjects, or regulators; (b) any breach by you of the AUP in Section 5 or of your responsibilities under Section 6; (c) any unlawful, infringing, or fraudulent use of the Service by you or by any person acting on your behalf; (d) any allegation that your scraper configuration or scraped output infringes a third-party intellectual property or privacy right. Trawl will give you prompt notice of any indemnifiable claim, will allow you to assume control of the defence (with counsel of Trawl's reasonable approval), and will cooperate at your reasonable expense.
14. Suspension and Termination
Trawl may suspend the Service immediately and without prior notice in case of (a) breach of the AUP or any other material breach of these Terms; (b) credible security risk, including credential leak, abusive consumption, or evidence of compromised infrastructure; (c) non-payment of fees beyond the grace period set out below; (d) request by a competent authority. For non-payment, Trawl will give a written notice and a grace period of thirty (30) days; if the User has not regularised payment by the end of the grace period, Trawl may suspend or terminate the Subscription. Suspension does not relieve the User of any payment obligation that has accrued before the suspension date.
If you believe content collected through Trawl infringes your copyright, send a written notice to brisorgueilp@gmail.com including: (1) physical or electronic signature of the rights holder or authorized representative; (2) identification of the copyrighted work claimed to have been infringed; (3) URL or scrape job ID concerned; (4) your contact information (name, address, phone, email); (5) a good-faith statement that the use is unauthorized; (6) a sworn statement under penalty of perjury that the information is accurate. Trawl responds within fourteen (14) business days and may suspend the relevant scrape job pending review.
The User may terminate the Subscription at any time through the dashboard. Termination takes effect at the end of the then-current paid period; access continues until that date. No refund is due upon User-initiated termination except as expressly provided in the Refund Policy at /refund. Upon termination of the Service Agreement, Trawl deletes Personal Data in accordance with Section 12 of the DPA.
15. Refund Policy
The conditions under which a refund may be granted are set out in the Refund Policy at /refund, which forms an inseparable part of these Terms. The Refund Policy includes, in particular, a B2B carve-out from the consumer right of withdrawal, the rules for refunds in case of material Service failure, the goodwill refund window for first-time customers, and the procedure to request a refund.
16. Sanctions and Geographic Restrictions
The user warrants that they are not located in, nor a national or resident of, any jurisdiction subject to comprehensive sanctions imposed by the European Union, the United States Office of Foreign Assets Control (OFAC), or the United Nations Security Council. The user further warrants that they are not listed on the EU consolidated sanctions list, the OFAC Specially Designated Nationals (SDN) list, or any equivalent restricted-party list. Use of Trawl Services from embargoed countries is strictly prohibited.
Trawl may at any time, and without liability, refuse, suspend, or terminate access to the Service where such access would expose Trawl to a breach of an applicable sanctions regime.
17. Changes to Terms
Trawl may amend these Terms from time to time. Material changes will be notified to the User by email at the address registered with the account and via a banner displayed in the dashboard, at least thirty (30) days before the effective date. Continued use of the Service after the effective date constitutes acceptance of the amended Terms. If the User does not accept a material change, the User may terminate the Subscription before the effective date, in which case the existing version of the Terms remains in force until termination.
Non-material changes (typographical corrections, clarifications, updates to sub-processor lists in line with the procedure set out in the DPA) take effect on publication.
18. Governing Law and Jurisdiction
These Terms are governed by French law, to the exclusion of conflict-of-law rules. Any dispute arising out of or in connection with these Terms, including disputes regarding their existence, validity, or termination, shall be submitted to the exclusive jurisdiction of the Tribunal de Commerce de Paris. Where the User is a consumer (which is contractually excluded under Section 4 and the Refund Policy at /refund), mandatory consumer protection rules of the User's country of residence may nevertheless apply.
19. Miscellaneous
Force majeure. Neither Party is liable for any delay or failure in performance arising from circumstances beyond its reasonable control within the meaning of Article 1218 of the French Code civil, including without limitation acts of war, terrorism, civil unrest, natural disasters, large-scale infrastructure outages, or governmental actions.
Severability. If any provision of these Terms is held invalid or unenforceable, that provision shall be amended to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
No waiver. Failure by Trawl to enforce any provision of these Terms shall not constitute a waiver of that provision or of the right to enforce it later.
Entire agreement. These Terms, together with the Privacy Policy, the Refund Policy, the DPA, and the Mentions légales, constitute the entire agreement between the Parties on the subject matter and supersede any prior understanding.
Assignment. The User may not assign these Terms without the prior written consent of Trawl. Trawl may assign these Terms in whole or in part to any successor or affiliate, including in the context of a merger, acquisition, reorganisation, or asset transfer.
